2. Platform Description and Eligibility

AnimCard is an online platform that enables users to create animated cards and promotional videos for social media marketing and product promotion. The Platform provides tools for content creation, editing, exporting, and sharing.

2.2 User Eligibility

You must be at least 13 years of age to use this Platform. By registering, you warrant that you have the legal capacity to enter into these Terms. If you are under 18, you must have parental or guardian consent. AnimCard is not responsible for unauthorized use by minors.

3. User Accounts and Responsibilities

By creating an account, you agree to:

Maintain the confidentiality of your password and account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

AnimCard is not liable for unauthorized account access or use of your credentials.

4. License and Usage Rights

AnimCard grants you a limited, non-exclusive, non-transferable, revocable license to use the Platform for:

Creating animated content for personal use
Creating marketing and promotional materials for your products/services
Exporting and sharing content on social media platforms

You may not:

Resell, redistribute, or sublicense the Platform or its features
Reverse engineer, decompile, or attempt to discover source code
Modify, adapt, or create derivative works based on the Platform
Use the Platform for illegal or harmful purposes

5. User-Generated Content

5.1 Ownership

You retain all rights to content you create on AnimCard ("User Content"). You are responsible for ensuring that your User Content does not infringe upon third-party intellectual property rights.

5.2 Grant of Rights

By uploading content to AnimCard, you grant the Platform a worldwide, royalty-free, non-exclusive license to store, process, host, and display your content to provide the service.

5.3 Prohibited Content

You agree not to create or upload content that:

Violates intellectual property rights, copyrights, or trademarks
Contains illegal, defamatory, harassing, or hateful material
Promotes violence, discrimination, or illegal activities
Includes explicit sexual content or child exploitation
Constitutes spam, malware, or phishing attempts
Infringes on privacy or personal rights of others

6. Intellectual Property Rights

All materials on AnimCard, including the Platform design, functionality, graphics, text, and animations, are the property of AnimCard or its licensors. You agree not to reproduce, distribute, or use any part of the Platform's intellectual property without express written permission.

7. Third-Party Content and Links

AnimCard may contain links to third-party websites and services. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party services is governed by their terms and conditions. AnimCard does not endorse any third-party content or services.

8. Payment and Subscription Terms

For paid features or subscriptions:

You agree to provide accurate billing information
Charges are in USD and will be clearly displayed before purchase
Subscription fees are non-refundable unless required by law
AnimCard may change pricing with 30 days' notice
We reserve the right to suspend service for unpaid accounts

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANIMCARD IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ANIMCARD DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL ANIMCARD BE LIABLE FOR:

Any indirect, incidental, special, or consequential damages
Loss of data, revenue, or profits
Service interruptions or errors in the Platform
Content created by users or third parties

Your sole remedy for any Platform issues is to stop using the service.

10. Indemnification

You agree to indemnify, defend, and hold harmless AnimCard, its owners, and employees from any claims, damages, or liabilities arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

11. Termination of Service

AnimCard may terminate or suspend your account at any time without notice or liability if you:

Violate these Terms or applicable laws
Engage in harmful, illegal, or abusive conduct
Create content that violates intellectual property rights
Engage in activity that disrupts the Platform

Upon termination, your right to use AnimCard immediately ceases.

12. Export Control

You agree to comply with all applicable export control laws. You may not use AnimCard to export content to countries subject to U.S. sanctions or embargoes.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the courts.
